When Does a Deck Need a Permit in Ontario?
Under the Ontario Building Code, a building permit is required when:
- The deck is attached to the house (at any height)
- Deck surface is more than 600mm (24 inches) above finished grade
- Deck area exceeds 10 square metres (108 sq ft)
- The deck is covered — pergola with solid roof, screened enclosure, or sunroom
- The deck includes a hot tub, pool, or structural spa
- The deck extends over a walkout basement or ravine
